These Terms & Conditions ("Terms") are a legal agreement between you and Off Leash ("Off Leash", "we", "us", or "our") governing your access to and use of the Off Leash mobile application and related services (the "App"). Please read them carefully.

By creating an account, signing in, or otherwise using the App, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.

These Terms contain important provisions limiting our liability and describing how disputes are resolved. Please review them carefully.

1. Eligibility

You must be at least 13 years old to use the App. If the age of digital consent in your country is higher than 13, you must meet that age. By using the App, you represent that you meet this requirement, that the information you provide is true and accurate, and that your use of the App will not violate any law that applies to you.

The App is not directed to children, and we do not knowingly allow children below the applicable age of consent to create accounts. See our Privacy Policy for more information.

2. Your Account

To use most features you need an account. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at support@off-leash.dog if you suspect unauthorized access.

You agree to provide accurate, current, and complete information when creating your account and to keep it up to date. You may have only one account at a time.

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use. All rights not expressly granted are reserved.

You agree not to:

Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits.
Rent, lease, lend, sell, sublicense, or otherwise transfer rights to the App.
Remove, alter, or obscure any proprietary notices in the App.
Use the App to build a competing product or to scrape, harvest, or extract data about other users or parks.

4. Your Content and the License You Grant Us

You retain ownership of the content you submit through the App — your dog profiles, photos, messages, park photos, park information updates, reports, feedback, and any other material you submit ("Your Content").

By submitting Your Content, you grant Off Leash a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for technical purposes such as resizing), create derivative works of, display, perform, and distribute Your Content solely for the purpose of operating, providing, and improving the App and the features you use (including making Your Content visible to the other users you choose to share it with). This license ends when you delete Your Content or your account, except that (a) backups and audit logs may persist for a limited time before being overwritten, and (b) messages and content already shared with other users may remain in their copy of the conversation.

You represent and warrant that:

You own or have all rights necessary to grant the license above.
Your Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party.
Your Content does not violate these Terms or any applicable law.

5. Acceptable Use

You agree not to use the App to:

Post false, misleading, deceptive, fraudulent, or impersonating content.
Harass, threaten, stalk, intimidate, dox, or otherwise abuse another person or their pet.
Post or share content that is unlawful, defamatory, obscene, pornographic, sexually explicit, hateful, discriminatory, violent, or that promotes self-harm.
Encourage or facilitate cruelty to animals, dog fighting, unsafe breeding, or any other practice that harms animals.
Solicit personal information from minors or otherwise endanger minors.
Violate any applicable law, regulation, or third-party right, including intellectual property, privacy, or publicity rights.
Attempt to access another user's account or any non-public area of the App, or interfere with the App's normal operation.
Upload viruses, malware, or other harmful code, or run automated scripts, scrapers, or bots against the App.
Use the App for any commercial purpose without our prior written consent, including advertising, selling products or services, sending spam, or recruiting users to other services.

6. Objectionable Content and Reporting

Off Leash has zero tolerance for objectionable content and abusive behavior. You can report any user, dog, or message from within the App — open a conversation and tap the flag icon, or open a dog profile and use the report action — and you can block any user at any time. We review every report and aim to remove objectionable content and remove or restrict offending accounts promptly, generally within 24 hours of receiving an actionable report.

By using the App you agree to these standards. If you encounter content or behavior that violates them, please report it so we can act.

7. Real-World Interactions and Safety

Off Leash helps you discover parks and connect with other dog owners, but in-person meetings and dog-to-dog interactions happen entirely at your own risk. We do not screen, verify, or endorse other users, their dogs, their vaccination or health status, their handling skills, or any information they share.

You are responsible for your dog. You alone are responsible for your dog's behavior, health, vaccinations, training, supervision, and compliance with local leash laws and park rules.
Use good judgment. Off-leash environments can be unpredictable. Do not bring a sick, in-heat, aggressive, unvaccinated, or unsuitable dog to a public park.
Meet safely. When meeting people you've connected with through the App, meet in a public place, trust your instincts, and disengage if you feel unsafe.

To the maximum extent permitted by law, Off Leash is not liable for any injury, illness, loss, or damage to you, your dog, or any third party arising out of a meeting, check-in, connection, or other real-world interaction enabled by the App.

8. Park Information

Park information shown in the App — including locations, hours, amenities, surface type, and busyness — is compiled from public sources and from user contributions. It may be incomplete, outdated, or inaccurate. Always confirm hours, access, and rules with the park's official source before you rely on them.

9. Third-Party Services

The App uses third-party services to operate — including Apple, Google, Supabase, Mapbox, Sentry, and Expo. Your use of those services through the App is also subject to those providers' own terms and policies. We are not responsible for third-party services or content.

10. Push Notifications and Communications

With your permission, we send push notifications about activity in the App. You can change the categories you receive, set Quiet Hours, or turn notifications off at any time in Settings or in iOS Settings → Off Leash → Notifications. We may also send transactional emails about your account (such as verification, password reset, and important service notices); those cannot be opted out of while your account is active.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what information we collect, how we use and share it, and your privacy choices.

12. Suspension and Termination

You may stop using the App at any time and permanently delete your account in Settings → Delete Account. We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms, create risk or legal exposure for us or other users, or if we are required to do so by law. Provisions that by their nature should survive termination will survive (including license grants for Your Content already shared, disclaimers, limitation of liability, indemnification, and dispute resolution).

13. Modifications to the Service

We are continually improving the App and may add, change, suspend, or discontinue features at any time. We will try to give reasonable notice of material changes, but we are not obligated to maintain any specific feature.

14. Pricing

The App is currently free to download and use. We may introduce optional paid features in the future. If we do, we will clearly disclose the price and terms before you are charged, and any purchase will be subject to Apple's App Store payment terms or another payment processor's terms in addition to these Terms.

15. Intellectual Property

The App, including its software, design, text, graphics, logos, and other content (other than Your Content and content licensed from third parties), is owned by Off Leash or its licensors and is protected by intellectual property laws. The Off Leash name, logo, and product names are trademarks of Off Leash. You may not use them without our prior written permission.

If you believe content in the App infringes your copyright, please send a notice including the elements required by the Digital Millennium Copyright Act (DMCA) to support@off-leash.dog.

16. Feedback

If you send us suggestions, ideas, or feedback about the App, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose without obligation or compensation to you. We may, but are not obligated to, act on any feedback.

17. Disclaimers

To the maximum extent permitted by law, the App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or quiet enjoyment. We do not warrant that the App will be uninterrupted, error-free, or secure, that defects will be corrected, or that the content (including park information and user-submitted content) is accurate, complete, or reliable.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply only to the maximum extent permitted by applicable law, and nothing in these Terms limits any rights you have as a consumer that cannot be waived.

18. Limitation of Liability

To the maximum extent permitted by law, in no event will Off Leash or its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or use, arising out of or related to your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our aggregate liability for all claims arising out of or related to the App or these Terms will not exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Without limiting the foregoing, Off Leash is not liable for any injury, illness, behavioral incident, loss, or damage involving any dog or person resulting from a meeting, check-in, or other real-world interaction enabled by the App.

19. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Off Leash and its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) your use of the App, (c) your violation of these Terms or any law, or (d) your violation of any third-party right.

20. Apple-Specific Terms

The following terms apply if you obtained the App from the Apple App Store:

These Terms are between you and Off Leash only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
The license granted to you for the App is limited to a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Apple has no obligation to provide any maintenance or support for the App.
In the event that the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Off Leash, not Apple, is responsible for addressing any claims relating to the App or your possession or use of it, including (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of a third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Off Leash (not Apple) is responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the App.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The state and federal courts located in New York County, New York will have exclusive jurisdiction over any dispute that is not subject to arbitration or small-claims court, and you and Off Leash consent to the personal jurisdiction of those courts.

Informal resolution first. Before filing a claim, please contact us at support@off-leash.dog with a description of the dispute and the relief you seek. We will try to resolve your concern within 30 days.

Consumer rights you cannot waive. Nothing in this section limits any rights you have as a consumer under the mandatory laws of the country in which you reside.

22. Export Controls

You may not use, export, or re-export the App in violation of U.S. export laws or the laws of any other applicable jurisdiction. You represent that you are not located in, under the control of, or a national or resident of a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

23. Changes to These Terms

We may update these Terms from time to time. When we make a material change, we will update the "Effective" date at the top of this page and, where appropriate, notify you in the App or by email. Your continued use of the App after the effective date constitutes acceptance of the updated Terms. If you do not agree, stop using the App and delete your account.

24. Miscellaneous

These Terms, together with the Privacy Policy and any other policies referenced in them, are the entire agreement between you and Off Leash regarding the App and supersede any prior agreements on the same subject. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
